« Le bail étudiant doit impérativement être mis au nom de l’étudiant et non à celui des parents, même si ce sont eux qui payent le loyer ou en sont les garants », souligne la FNAIM. En effet, si le bail est au nom des parents, celui-ci ne pourra pas recevoir d’aide au logement.
Pas de reconduction tacite du bail
En outre, le bail étudiant permet l’absence de renouvellement ou de reconduction tacite du bail à la fin du contrat. « Le locataire étudiant et le propriétaire doivent donc signer à nouveau un bail s’ils veulent continuer à louer dans les mêmes conditions », explique la FNAIM.
Ainsi, il n’est pas nécessaire d’envoyer une lettre de résiliation à la fin du bail. Le bailleur est assuré de pouvoir récupérer son bien au bout des neuf mois. L’été, le logement pourra être loué en meublé touristique.
Résiliation du bail étudiant à tout moment
Enfin, le bail étudiant peut être résilié à tout moment par le locataire. Il suffit d’envoyer au propriétaire une lettre recommandée avec accusé de réception et respecter un délai de préavis d’un mois. Le bailleur, quant à lui, ne peut pas mettre fin au contrat en cours de bail.
